An item in a recent issue of the National Low Income Housing Coalition’s MEMO to Members discusses HUD’s recent rejection of Westchester County’s Affirmatively Furthering Fair Housing (AFFH) certification as part of its disapproval of the county’s ConPlan (the approval of a Consolidated Plan is a requirement for a jurisdiction to receive CDBG, HOME and other HUD block grant funds). This HUD action follows a significant U.S. District Court ruling that the county had not conducted a proper fair housing Analysis of Impediments (AI) in connection with its recent AFFH certifications. In that case, a local fair housing organization sued the county, alleging it had violated the Federal False Claims Act by submitting false AFFH certifications. HUD has told the county that it will provisionally accept the current certification if the county follows through on an agreement to settle the pending case.
