Renters in Foreclosure
A recent research focus of the National Low Income Housing Coalition has been the issue of the impact of the foreclosure crisis on renters. The materials it has produced and assembled can be found at http://www.nlihc.org/template/page.cfm?id=159.
In Michigan, renters have the right to remain in their rental premises throughout the foreclosure process, and at least until the expiration of the redemption period following a foreclosure sale. There is no clear law stating that beyond that point tenants have a right to remain, and so, they are vulnerable to eviction after the redemption period expires. Bills have been introduced in the current session of the Michigan Legislature that would make clear that lease rights survive foreclosure, and they would also require that tenants be given at least 90 days notice after the conclusion of the foreclosure process before an eviction case could be filed against them.
