Issue Summary:

The Michigan Family Independence Agency has issued policy requiring Medicaid and Adult Medical Program (AMP) applicants and recipients who own U.S. Savings bonds to seek waiver of the waiting period to cash their bonds, if the cash value of the bonds would make the individual over-asset for Medicaid or Adult Medical Program.

What's Happening?

Effective July 1, 2004, FIA policy requires Medicaid and AMP applicants or recipients to request waiver of the 12 month waiting period for cashing in U.S. Savings bonds, if the value of the bond would put the individual over the Medicaid or AMP asset limit.

What Should Clients Do?

If FIA tells you to request a waiver of the 12 month waiting period, be sure to let your worker know if you need help with the waiver request. If you do not think the value of the savings bond would make you over-asset for Medicaid, seek legal advice.If you are denied Medicaid because of assets or because you fail to request a waiver of the 12 month waiting period, seek legal advice.
